Accused Zumba pimp trial begins in disorder

It takes 12 to tango.

The prosecution of Mark Strong, who has been accused of helping a Maine woman run a prostitution ring from her Zumba workout studio, has run up against an unexpected series of complications this week as the court failed to seat a jury.

Topping the problems off on Friday, Judge Nancy Mills unexpectedly dropped 46 of the 59 misdemeanor counts against Strong ? spurring an immediate appeal by attorneys for the state.


Prosecutors say that the men of Maine were knocking down the doors of Alexis Wright?s Pura Vida dance and exercise studio between Oct. 2010 and Feb. 2012, and that Strong helped Wright run a prostitution ring from the storefront in the seaside town of Kennebunk.

Strong pleaded not guilty in October to 59 counts including promotion of prostitution and conspiracy to commit promotion of prostitution.

All of the 46 counts against Strong dropped by Mills on Friday were invasion of privacy charges related to allegations that Wright videotaped herself with clients.

A separate trial for Wright, who has pleaded not guilty to 106 counts, including 45 counts of engaging in prostitution, is not expected to begin until May.

But four days after Strong?s case was supposed to get under way, the high-publicity, slow-simmering case of small-town indiscretion still does not have a jury.

As of Friday, zero jurors had been seated out of a pool of 140 after a series of closed-door selection proceedings, director of court information Mary Ann Lynch confirmed in an email.

The case in Mills? court also drew into itself, lobster pot-like, a new round of court filings as Maine Today Media, which owns the local Portland Press Herald, filed to put a stop to the secret voir dire hearings.

After Maine Today Media protested on Tuesday, a trial court at first agreed to open the proceedings, but Strong and his attorney objected, expressing ?concerns about the ability to draw an impartial jury if the process used by the court were changed,? according to court documents.

In an affidavit filed Tuesday by Maine Today Media, reporter Scott Dolan said that jury selection went on in the courthouse?s basement while members of the press sat in the hallway outside an empty courtroom.

The closed door sessions were finally halted on Thursday, when the state?s highest court ruled in a 6-1 decision that they had to be opened to the public.

?Everything I?ve done in the past few days has been appealed,? Justice Mills said in court at one point Thursday, according to the Press Herald.

The decision to open up the hearings was precedent-setting for Maine, said Sigmund Schutz, counsel to the Press Herald.

??It?s going to ensure that all aspects of the Alexis Wright trial are conducted in public, at least unless the court makes a decision to the contrary,? he told NBCNews.com.

While it is unclear how long it may take to prepare the court-ordered transcripts of the jury hearings held so far, a confidential juror questionnaire given to the pool was released on Wednesday.

The questionnaire listed 47 people accused of being clients of Wright, and asked if the potential jurors had ever discussed the individual?s cases with friends, family, or co-workers. It also asked if they knew or were related to any of the 72 people who may be called as witnesses in the case.

?You may be shown explicit videos and photographs depicting individuals engaged in graphic sexual acts,? the questionnaire asked. ?Would viewing this evidence make it difficult for you to listen to the law and evidence and render a fair and impartial verdict??

The questionnaire warned of as many as three weeks of testimony, from Wednesday of this week through Friday. Feb. 8. Court broke for the day Friday without a clear date for when testimony may actually begin, Lynch confirmed.

Also in the questionnaire: ?If the evidence shows that Alexis Wright was a prostitute, would the fact that defendant Mark Strong had a sexual relationship with her, not for money, make it difficult for you to find defendant Mark Strong not guilty of the crime of promotion of prostitution??

And: ?Do you know Alexis Wright or any member of her family??

That question gets to the crux of problem with finding jurors: Many townspeople may have gotten to know Alexis Wright all too well -- or known someone who has.

And putting a lid on rampant gossip about the trial might be beyond Mills? powers. The superior court in Alfred, Maine is only about 15 miles from where Wright operated her Zumba studio in Kennebunk.

The close-knit town of 10,000 was rattled when police began releasing the names of Wright?s alleged clients in October, in one case leading to a local high school hockey coach stepping down from his job.

??Are you a close friend or family member of any other member of the jury pool?? asked the questionnaire jurors were given. ?Do you work with any member of the jury pool??

In fact, Strong?s attorney argued in a motion filed earlier this month that it would be ?impossible? to find a York County jury free of some sort of bias against his client.

We recently saw research that suggested negative radiation pressure in light could lead to a practical tractor beam. A partnership between the Czech Republic's Institute of Scientific Instruments and Scotland's University of St. Andrews can show that it's more than just theory: the two have successfully created an optical field that flipped the usual pressure and started pulling objects toward the light. Their demo only tugged at the particle level -- sorry, no spaceships just yet -- but it exhibited unique properties that could be useful here on Earth. Scientists discovered that the pull is specific to the size and substance of a given object, and that targets would sometimes reorganize themselves in a way that improved the results. On the current scale, that pickiness could lead to at least medicinal uses, such as sorting cells based on their material. While there's more experiments and development to go before we ever see a tractor beam at the hospital, the achievement brings us one step closer to the sci-fi future we were always told we'd get, right alongside the personal communicators and jetpacks.

During the days leading up to this year's Super Bowl on Feb. 3, you can count on three things - a litany of stories on the teams' two coaches who just happen to be brothers, buzz about TV commercials that will cost $4 million and the feds cracking down on street vendors hawking phony, unlicensed NFL jerseys, shirts and hats.

Such was the case Friday when federal agents and Las Vegas police displayed counterfeit sports gear ranging from Chicago Bears and New York Jets jerseys to bags bearing the logos of the Pittsburgh Steelers, Denver Broncos and Green Bay Packers.

In all, about 600 fake items with a retail value of $15,000 were confiscated three days earlier by U.S. Immigration and Customs Enforcement, Homeland Security Investigations and Las Vegas police officials. Agents said Mustafa Ahmadi, 31, and Sonia Qudrat, 29, used a screen press at a Fremont Street Experience kiosk in downtown Las Vegas to apply professional sports teams logos downloaded off the Internet to shirts, jerseys, hats and scarves.

The two were arrested on charges of selling counterfeit goods and face a Class D felony, punishable by up to one to four years in prison and a $5,000 fine.

Sports retailers who sell legitimate licensed NFL and other sports gear celebrated.

"I was jumping for joy. This is awesome," said Bruce Mianecki, owner of Uniform Sports, a retail store in the Las Vegas Premium Outlets South.

Mianecki said he reported the kiosk vendors to his Nike representatives in hopes authorities would be alerted. Nike is the NFL supplier of licensed jerseys. Mianecki said he also has contacted Craigslist about people selling phony, unlicensed NFL gear on that website.

"I have to compete with these guys. They undercut me. They sell a jersey for $40 or $60, and my top jersey goes for $250. And they're not putting any money into the tax base," Mianecki said.

Federal authorities are cracking down on phony sports logo gear in 30 other cities as part of its national Operation Red Zone program.

The NFL, which hires local companies to identify vendors pitching unlicensed merchandise in dozens of markets nationwide, lauded Friday's news.

"We appreciate the effort from federal and local authorities in taking these counterfeit items off the streets," NFL spokesman Brian McCarthy said. "These counterfeiters aren't graphic artists - they're con artists. Our fans deserve the best from the NFL, and these counterfeiters dupe them into buying inferior merchandise and also harm local retailers."

Vendors selling phony gear hurts the city's tourism economy because unsuspecting tourists buy inferior, unlicensed merchandise and don't return because of the negative experience, said Las Vegas police Detective Robert Sigal, who worked on the case.

"They won't come back to the city," Sigal said. "We want them to leave with good memories."

Authorities said the arrested vendors made thousands of dollars from the sports knockoffs for the past few months. A month ago, federal agents also seized phony NFL jerseys that were sent from China and bound for a Henderson man.

Michael Harris, assistant special agent in charge, said the counterfeit sports gear is just a slice of a bigger illegal movement of phony merchandise that ranges from fake car parts and contact lenses to medicine.

U.S. retailers lose $200 billion to $250 billion annually in sales because of phony merchandise, Harris said.

Steven Sampilo, a Homeland Security special agent involved in the sports gear crackdown, said there is another dubious element: "A lot of counterfeiting supports terrorism."

Cops on alert as India gang-rape trial gets under way - World News

NEW DELHI -- Five suspects, their faces covered with woolen caps, arrived in a special fast-track New Delhi court Thursday for the start of their trial for the rape and murder of a young woman on a bus last month in a case that triggered outrage and questions over the treatment of women in India's justice system.

Police were on alert outside the sprawling court complex in south New Delhi as the suspects arrived. Inside the court, about 30 policemen blocked access to the room where the trial was to be held, while scores of journalists and curious onlookers crowded the hallway.

The suspects were whisked into the courtroom by a phalanx of armed policemen for the start of the trial, although no immediate details were released.

The court will hear opening arguments by the prosecution and defense lawyers. The trial will be conducted in a closed court room after Judge Yogesh Khanna denied a defense motion to make the proceedings public.

A sixth suspect says he is a juvenile and is expected to be tried in a juvenile court.

Police say the victim and a male friend were attacked after boarding a bus Dec. 16. The attackers beat the man and raped the woman, inflicting massive internal injuries with a metal bar, police said. The victims were dumped naked on the roadside, and the woman died two weeks later in a Singapore hospital.

Five men, accused of the rape and murder of a medical student in India have appeared in court. If convicted they face the death penalty. The attack on a bus three weeks ago sparked outrage and violent protests in the country. ITV's Geraint Vincent reports.

The trial began a day after a government panel recommended India strictly enforce sexual assault laws, commit to holding speedy rape trials and change the antiquated penal code to protect women.

The panel appointed to recommend suggestions to overhaul the criminal justice system's handling of violence against women, received 80,000 suggestions from women's and rights groups and thousands of ordinary citizens.

Among the panel's suggestions were a ban on a traumatic vaginal exam of rape victims and an end to political interference in sex-crime cases. It has also suggested the appointment of more judges to help speed up India's sluggish judicial process and clear millions of pending cases.

Law Minister Ashwani Kumar said the government would take the recommendations to the Cabinet and Parliament.

Cynthia Waldmeier took some time to talk to us about the great work they do to support women dealing with addiction.

The Amethyst Women?s Addiction Centre is one of the beneficiaries of proceeds from our Women of Comedy night on February 6th, which features an intimate and interactive evening with Sheila McCarthy, Deb McGrath and Nikki Payne.

CUTC: Tell us a bit about the Amethyst Women?s Addiction Centre and what it does:

CW: The Amethyst Women?s Addiction Centre was the first addiction treatment centre of its kind in Canada when it opened its doors in 1979 in Ottawa, Ontario.? The Amethyst Women?s Addiction Centre offers alternative addiction services to women.? Amethyst is committed to working with diverse and marginalized groups of women.? Our aim is to support women, individually and together, to take control of factors affecting our health and well-being.? Amethyst is grounded in the feminist belief that women?s experiences with alcohol, drugs and gambling cannot be separated from our experiences and status as women.? CUTC: Why is supporting mental health so important in our community, and how can laughter help?

CW: Laughter and humour can be coping mechanisms that can help people to ride out many difficult life situations. Laughter is often regarded as the medicine of soul. Good healthy humour (which means not laughing at others but laughing with others) improves human connection and is the shortest route to friendships. Scientifically speaking, laughter and humour increases oxygen consumption by brain cells. MRI study shows that laughter can increase blood supply to neurons more than any other brain activity can do. Laughter is used as a medicine in many terminal illnesses as it can improve longevity and boost immune system. Full belly laughter for about an hour can also burn calories. It reduces stress level, relaxes body muscles and brings back the balance of neurochemistry.

CUTC: What kinds of mental health support does the Amethyst Women?s Addiction Centre provide?

CW: Addiction and metal health issues are closely interlinked. Addiction itself can also be a mental health issue as an ? impulse control disorder?. The rates of depression, personality Disorder, anxiety disorder are very high in addicted population. Besides, the link between Trauma and addiction is also well established by now. Addiction is actually the tip of an iceberg. Sometimes people become addicted as a consequence of self-medicating their underlying issues including mental health problems. Some people develop mental disorders as result of substance abuse too. So, it actually forms a vicious cycle.

CUTC: How do your programs help women and their families?

CW: Our Centre offers the following programs which benefit women struggling with addiction issues:

  • A confidential and free Intensive Program to women who are dependent on alcohol and/or drugs. Treatment intensity and duration are tailored to individual women?s needs
  • A Sexual Abuse Support Program that provides group and individual counselling support to clients as they heal from the trauma of childhood abuse

Revolutionary theory of dark matter

Jan. 24, 2013 ? The universe abounds with dark matter. Nobody knows what it consists of. University of Oslo physicists have now come up with a mathematical explanation that could solve the mystery once and for all.

Astrophysicists have known for the last 80 years that most of the universe consists of an unknown, dark matter. The solution to the mystery may now be just around the corner.

"We are looking for a new member of our particle zoo in order to explain dark matter. We know that it is a very exotic beast. And we have found a plausible explanation," reports Are Raklev, an associate professor in particle physics in the University of Oslo's Department of Physics to the research magazine Apollon. ?He is the university's leading theorist in astroparticle physics and has launched a model that explains what dark matter may consist of and how one can discover the invisible particles experimentally.

Even though dark matter is invisible, astrophysicists know it exists. Without this dark matter it is impossible to explain how the visible things in the universe hang together.

An 80-year fight

The world famous, Swiss physicist Fritz Zwicky was speculating on what dark matter might be as early as the 1930s.

Astrophysicists have calculated that 80 per cent of all the mass in the universe is dark, invisible matter. Thanks to gravity this dark matter clumps together as ordinary matter.

Dark matter can explain why stars move like they do. Dark matter may also explain the rotation speed of galaxies.

"Even though we can calculate how much dark matter there is in the universe, we still know little about what dark matter is. The particles in dark matter must either have a lot of mass, or there must be very many of them. Neutrinos meet all the requirements of dark matter. But there is one big difficulty. They have far too little mass."

Are Raklev is now trying to prove that dark matter consists of gravitinos. This is a particle that has been unfairly treated for years.

And just what are gravitinos? Hold tight: gravitinos are the supersymmetric partner of gravitons.

Or, to be even more precise:? "The gravitino is the hypothetical, supersymmetric partner of the hypothetical particle graviton, so it is also impossible to predict a more hypothetical particle than this," laughs Raklev, who writes on his web pages that he is looking for dark material both under his sofa and other places.

In order to dig deeper into why Raklev believes dark matter consists of gravitinos, and have any chance at all of understanding the theory behind gravitinos, Apollon has to take a couple of steps back:

Step 1: Supersymmetry

Physicists want to find out whether or not nature is supersymmetric. Supersymmetry means that there is a symmetry between matter and forces. For each type of electron and quark there is a corresponding heavy, supersymmetric partner. The supersymmetric particles were created in the instant after the Big Bang. If some of them have survived to today, they may be what dark matter is made of.

The supersymmetric partner of the gravitino is, as Apollon said, the graviton.

"A graviton is the particle we believe mediates gravitational force, just like a photon, the light particle, mediates electromagnetic force. While gravitons do not weigh anything at all, gravitinos may weigh a great deal. If nature is supersymmetric and gravitons exist, then gravitinos also exist. And vice versa. This is pure mathematics."

But there is a small but. Physicists cannot demonstrate the relationship between gravitons and gravitinos before they have managed to unify all the forces of nature.

Step 2: The forces of nature

One of the biggest things physicists long to do is to unify all the forces of nature in a single theory. In the middle of the last century physicists discovered that electricity and magnetism were part of the same force of nature. This force has since been called electromagnetism. Two of the other forces of nature are the strong nuclear force and the weak nuclear force. The weak nuclear force can be seen in, among things, radioactivity. The strong nuclear force is ten billion times as strong and binds together neutrons and protons.

In the 1970s, electromagnetism was unified with the strong and weak nuclear forces in what physicists call the standard model.

The fourth force of nature is gravity. Even though it is unbelievably painful to fall down stairs, gravity is the weakest of the four forces of nature.

The problem is that physicists have not yet been able to unify gravity with the three other forces of nature. The day physicists gain a unified understanding of all four forces of nature, they will gain a unique understanding of the world. This will make it possible to describe all imaginable interactions between all possible particles in nature. Physicists call this the ToE Theory (Theory of Everything).

"In order to unify gravitational force with the other three forces of nature we have to understand gravity as quantum theory. This means we need a theory in which the particle graviton is included in the atomic nucleus."

Researchers are now looking for signs of both supersymmetry and the ToE Theory. Discovering the graviton would be an enormous step in this direction.

Reveals dark matter

As the reader may have understood, it is very difficult to research dark matter. This is because dark matter has no electromagnetic relationships to terrestrial particles at all. One example of dark matter is the aforementioned neutrino. Unfortunately, neutrinos make up only an imperceptibly tiny part of dark matter.

Even though it has not been possible to observe dark matter, several billion neutrinos race through your body every second. However, their speed is somewhat limited. The particles move just as slowly as the speed the solar system moves around the galaxy. In other words, a mere 400 kilometres a second.

"When there are no electromagnetic relationships with visible particles, the particles can pass right through us without any measuring instruments detecting them. This is where supersymmetry comes in. If supersymmetry is right, physicists can explain why there is dark matter in the universe. That is what is fun about my job," laughs Raklev.

He is now asserting that dark matter mostly consists of gravitinos.

"Supersymmetry simplifies everything. If the ToE Theory exists, in other words if it is possible to unify the four forces of nature, gravitinos must exist."

The gravitinos were formed right after the Big Bang.

"A short time after the Big Bang we had a soup of particles that collided. Gluons, which are the force bearing particles in the strong nuclear force, collided with other gluons and emitted gravitinos. Many gravitinos were formed after the Big Bang, while the universe was still plasma. So we have an explanation of why gravitinos exist."

Changed life span

Physicists have up to now viewed gravitinos as a problem. They have believed that the theory of supersymmetry does not work because there are too many gravitinos.

"Physicists have therefore strived to eliminate gravitinos from their models. We, on the other hand, have found a new explanation that unifies the supersymmetry model with dark matter that consists of gravitinos. If dark matter is not stable, but just very long lived, it is possible to explain how dark matter consists of gravitinos."

In the old models dark matter was always everlasting. This meant that gravitinos were a bothersome part of the supersymmetry model. In Raklev's new model, their life span is no longer endless. Nonetheless, the average life span of gravitinos is very long and actually longer than the life span of the universe.

However, there is a big difference between an unending life span and a life span of more than 15 billion years. With limited a life span, gravitinos must be converted into other particles. It is precisely this conversion effect that can be measured. And the conversion explains the model.

"We believe that almost all dark matter is gravitinos. The explanation lies in very hard mathematics. We are developing special models that calculate the consequences of these theories and we predict how the particles can be observed in experiments."

The measurements are underway

Researchers are now trying to test this experimentally and explain why these new particles have not yet been seen in the CERN experiments in Geneva in Switzerland.

"On the other hand, it should theoretically possible to observe them from a space probe."

The simplest way of observing gravitinos could be studying what happens if two particles collide out in the universe and are converted into other particles such as photons or antimatter.

Even though the collisions occur very rarely, there is still so much dark matter in the universe that a significant number of photons should be able to be produced.

The big problem is that gravitinos do not collide.

"At least it happens so rarely that we could never hope to observe it."

Nonetheless there is hope

"Luckily for us, gravitinos are not one hundred per cent stable. They are converted into something else at some point. We can predict what the signal looks like after gravitinos have been converted. The conversion will send out a small electromagnetic wave. This is also called a gamma ray."

NASA's Fermi-LAT space probe is currently measuring gamma rays. A number of research groups are now analysing the data.

"So far we have only seen noise. But one of the research groups claim they have observed a small, suspicious surplus of gamma rays from the centre of our galaxy. Their observations may fit our models," says the man behind the very difficult mathematical model for dark matter, associate professor in theoretical particle physics, Are Raklev.

(AP) ? Phil Mickelson says he should have kept his opinions on taxes to himself.

Mickelson had suggested "drastic changes" were in store for him because of changes in federal and state taxes that he says tap into more than 60 percent of his income. He said it was the reason behind his decision not to be part of the new ownership group of the San Diego Padres.

Mickelson says in a statement that finances and taxes are personal and he should not have publicized his complaints. He's apologizing to anyone insulted by his comments and says he won't let that happen again.

The San Diego native is to hold a news conference Wednesday at Torrey Pines.

A few years ago, Google?s human resources department noticed a problem: A lot of women were leaving the company. Like the majority of Silicon Valley software firms, Google is staffed mostly by men, and executives have long made it a priority to increase the number of female employees. But the fact that women were leaving Google wasn?t just a gender equity problem?it was affecting the bottom line. Unlike in most sectors of the economy, the market for top-notch tech employees is stretched incredibly thin. Google fights for potential workers with Apple, Facebook, Amazon, Microsoft, and hordes of startups, so every employee?s departure triggers a costly, time-consuming recruiting process.

Then there was the happiness problem. Google monitors its employees? well-being to a degree that can seem absurd to those who work outside Mountain View. The attrition rate among women suggested there might be something amiss in the company?s happiness machine. And if there?s any sign that joy among Googlers is on the wane, it?s the Google HR department?s mission to figure out why and how to fix it.

Google calls its HR department People Operations, though most people in the firm shorten it to POPS. The group is headed by Laszlo Bock, a trim, soft-spoken 40-year-old who came to Google six years ago. Bock says that when POPS looked into Google?s woman problem, it found it was really a new mother problem: Women who had recently given birth were leaving at twice Google?s average departure rate. At the time, Google offered an industry-standard maternity leave plan. After a woman gave birth, she got 12 weeks of paid time off. For all other new parents in its California offices, but not for its workers outside the state, the company offered seven paid weeks of leave.

So in 2007, Bock changed the plan. New mothers would now get five months off at full pay and full benefits, and they were allowed to split up that time however they wished, including taking some of that time off just before their due date. If she likes, a new mother can take a couple months off after birth, return part time for a while, and then take the balance of her time off when her baby is older. Plus, Google began offering the seven weeks of new-parent leave to all its workers around the world.

Google?s lavish maternity and paternity leave plans probably don?t surprise you. The company?s swank perks?free gourmet food, on-site laundry, Wi-Fi commuting shuttles?are legendary in the corporate world, and they?ve driven a culture of ever-increasing luxuries for tech workers. This week, for the fourth consecutive year, Google was named the best company to work for by Fortune magazine; Microsoft was No. 75, while Apple, Amazon, and Facebook didn?t even make the list.

At times Google?s largesse can sound excessive?noble but wasteful from a bottom-line perspective. In August, for example, Forbes disclosed one previously unannounced Google perk?when an employee dies, the company pays his spouse or domestic partner half of his salary for a decade. Yet it would be a mistake to conclude that Google doles out such perks just to be nice. POPS rigorously monitors a slew of data about how employees respond to benefits, and it rarely throws money away. The five-month maternity leave plan, for instance, was a winner for the company. After it went into place, Google?s attrition rate for new mothers dropped down to the average rate for the rest of the firm. ?A 50 percent reduction?it was enormous!? Bock says. What?s more, happiness?as measured by Googlegeist, a lengthy annual survey of employees?rose as well. Best of all for the company, the new leave policy was cost-effective. Bock says that if you factor in the savings in recruitment costs, granting mothers five months of leave doesn?t cost Google any more money.

The change in maternity leave exemplifies how POPS has helped Google become the country?s best employer. Under Bock, Google?s HR department functions more like a rigorous science lab than the pesky hall monitor most of us picture when we think of HR. At the heart of POPS is a sophisticated employee-data tracking program, an effort to gain empirical certainty about every aspect of Google?s workers? lives?not just the right level of pay and benefits but also such trivial-sounding details as the optimal size and shape of the cafeteria tables and the length of the lunch lines.

In the last couple years, Google has even hired social scientists to study the organization. The scientists?part of a group known as the PiLab, short for People & Innovation Lab?

run dozens of experiments on employees in an effort to answer questions about the best way to manage a large firm. How often should you remind people to contribute to their 401(k)s, and what tone should you use? Do successful middle managers have certain skills in common?and can you teach those skills to unsuccessful managers? Or, for that matter, do managers even matter?can you organize a company without them? And say you want to give someone a raise?how should you do it in a way that maximizes his happiness? Should you give him a cash bonus? Stock? A raise? More time off?
